To end 2020 and begin 2021 we have numerous court victories to report on.
Seven of our favourable substantive judgements were against Club la Costa (Paradise Trading, Continental Resorts and Sucursal). Altogether these cases accumulated to a huge total of £164,230 in monies awarded.
Other cases from these weeks included ones against Silverpoint, Diamond Resorts and Tasolán. These three cases saw a total of £78,260 in monies awarded for our clients.
In terms of jurisdiction judgements our legal team have also been very busy. In total we received 11 favourable jurisdiction judgements over the past fortnight.
To break these down; one case was against Silverpoint SL, two against Diamond Resorts, with the remaining eight being against CLC. Contractual names for the Club la Costa cases were CLC Sucursal and CLC Continental with one of the CLC cases also being against Hitachi Capital PLC.
During the Timeshare sales boom of the 80s & 90s, potential buyers were lured in by the promise of affordable exotic holidays, flexible exchange programmes and the impression that Timeshare would be a valuable "investment".
In an industry with little or no regulation, high pressure sales tactics were rife and contract smallprint was often glossed over and explained away by sharp salespeople.
Many Timeshare buyers were therefore unaware that they were actually making significant, long term financial commitments on behalf of themselves and their families.

For many Timeshare owners, annual maintenance fees were barely considered token amounts in the early "honeymoon period" of ownership.
