We are pleased to inform you of the recent Spanish court victories. M1 Legal secured TWENTY SIX positive awards amounting to £372,950.  The highest award from our latest figures revealed a case against Marriott totalling £47,750.

Please see below a breakdown of the substantive results:

1st Court of Instance:

  • Marriott x 3  - In Marbella, the judge declared the contracts null due to lack of property information.  Amounts awarded - £26,536, £26,070, £47,750.
  • Club Puerto Calma - In this next case, nullity was declared due to lack of property information.  Amount awarded - £11,560.
  • Restotel -  In Barcelona, the judge declared the contract null and void due to lack of contract duration and property information.  Amount awarded - £22,638.
  • RCI - In Torremolinos, nullity was declared due to lack of property and contract duration information.  Amount awarded - £10,696.

We also received positive judgments against Es Pueto, Heritage Resorts, Diamond Resorts and Anfi.

Appeals:

  • Anfi x 3  - The Court of Appeal declared nullity due to lack of property information in all three cases.  Amounts awarded - £12,553, £21,567, £44,109.
  • Diamond Resorts - In this case, the Court of Appeal has rejected the defendant's arguments which means the judgment from the First Instance still stands.  Amount awarded - £15,011.
  • Marriott - The Court of Appeal declared that the decision on this case was null and void for infringement of contract duration, for lack of purpose and for receiving prohibited advances within the period of three months which confirms that the judgement from the First Instance still stands.  Amount awarded - £25,000.
  • Lion Resorts - The Court of Appeal declared that the decision from the First Instance still stands based on the grounds of lack of property information.  Amount awarded - £15,246.
  • RCI - The Court of Appeal declared that the decision from the First Instance still stands based on the grounds that the contract exceeded the legal maximum duration of fifty years.  Amount awarded - £9,977.

All cases mentioned above will now proceed to the next step.
