Twenty three positive court awards valued at £318,657 including ten CLC cases totalling £197,965

We are pleased to inform you of the latest Spanish court victories for September. M1 Legal secured TWENTY THREE positive awards with a total value of £318,657. Our highest award from these latest results was against Club la Costa totalling £37,127. 

Please see below a breakdown of the substantive results:

1st Court of Instance:

  • Club la Costa x 4 - The judge declared the contracts null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012).  Amounts awarded - £13,115, £12,126, £20,679, £21,010.
  • Marriott  - Also in Marbella, the judge declared the contracts null due to lack of property and/or contract duration information, (Laws 42/1998|04/2012). Amount awarded - £25,330.
  • Heritage Resorts - The judge declared the contract null due to lack of property information. (Law 42/1998).  Amount awarded £18,936.
  • Pueblo Evita - In Torremolinos, The judge confirmed nullity of the contract Amount awarded £12,384.
  • Pearly Grey - In Arona, the judge confirmed nullity of the contract due to lack of property and contract duration information.  Amount awarded £10,346.
  • Diamond Resorts - In Fuengirola, the judge confirmed nullity of the contract.  Amount awarded £9,856.

We also received positive awards against Albonsai Ibiza, MGM, Pearly Grey, Club Puerto Calma and Royal Park Albatros.

Appeals:

  • Club la Costa x 7 -  The Court of Appeal has confirmed seven judgments from the First Instance that declared the contract null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012)  Amounts awarded - £18,642, £37,127, £17,525, £17,943, £12,414, £10,434, £16,950.
  • Marriott - The Court of Appeal has confirmed in full the judgment from the First Instance that declared the contract null due to lack of accommodation information, (Law 42/1998).  Amount awarded - £22,200.

We also received a positive decision regarding another case against Club la Costa.

All cases mentioned above will now proceed to the next step.
